Composition of the Advisory and Research Committee on the Improvement of the Procedure for the Appointment of Judges and its first meeting

 

The Advisory and Research Committee on the Improvement of the Procedure for the Appointment of Judges was composed and the first meeting was held on January 6, 2016 at the Supreme Court.

 

In the past, the grade from the Judicial Research and Training Institute (JRTI) was in fact the only factor that decided judge's appointment in the appointment procedure. However, with the revision of the Court Organization Act, the unification of judicial officers, which selects judges only among experienced legal professionals, was implemented in 2012. In particular, as lawyers who graduated from law schools were appointed as judges with graduates from the JRTI in 2015 for the first time, public attention and demand for the impartiality of the judge appointment procedure increased exponentially.

 

Since 2012, the Supreme Court has implemented the appointment procedures for a person having short-term legal experience, general legal experience and a judge in exclusive charge, depending on the length of their legal careers. At the same time, the Court has developed an evaluation of drafting legal papers, an interview for evaluations of practical performance and character and capability, an interview about legal ethics, multidirectional examination of a candidate and a systematic inquiry of opinion in order to objectively evaluate candidate's character and fitness exposed by their legal careers.

 

To search for the most appropriate procedure for the appointment of judges, with which the people can agree in the era of the unification of judicial officers, the Supreme Court organized the Advisory and Research Committee on the Improvement of the Procedures for the Appointment of Judges consisting of professionals in other fields as well as legal professionals. For this purpose, the Court sincerely and modestly listened criticism from outside and also accepted fresh and new ideas from various perspectives to the maximum.

 

Even though the evaluation of a candidate's fitness and capability in the procedure for the appointment of judges became much more difficult compared to the procedure in the past, the Supreme Court will collect various opinions regarding the methodology and reflect the result to the appointment procedure, recognizing that an impartial and transparent evaluation of legal career is of paramount importance.

 

The Supreme Court will continue to make its best efforts so as to make the procedure for the appointment of judges more impartial and transparent, ruminating over heavy responsibilities of the judiciary and judges who deal with people's lives and property and with the positive attitude towards accelerating the system improvement.
