[05_20_20] Oral Argument for the Case of the Cancellation of Union Deregistration Notification |

The full bench of the Supreme Court (Presiding judge: Chief Justice Kim Myeongsu) held an oral argument regarding the case of the cancellation of the deregistration notification of the Korean Teachers and Educational Workers Union at the Grand Courtroom on May 20, 2020 at 14:00, and it was broadcasted live.
At the argument, the attorneys representing the parties and reference witnesses to this case engaged in intense arguments regarding main issues including whether ‘the part of Article 9 Clause 2 of the Enforcement Decree of the Trade Union and Labor Relations Adjustment Act prescribed in Article 9 Clause 1 of the Enforcement Decree of the Act on the Establishment, Operation, etc. of Teachers’ Unions’, the provision which was applied to this case, deviated from the limit of delegated legislation, by prescribing the matters without the delegation of legal power of law, or prescribing new legal matters. Various specific points were also presented in the course of Justices’ fierce questioning.
