Overview of the Task Force on Responding to AI-Driven Fabricated Claims and Evidence

- With the advancement and widespread adoption of AI technology, there is a growing trend among litigants and legal professionals utilizing AI within judicial proceedings. There is raising concerns regarding the potential submission of fabricated laws, precedents, or forged evidence to courts, driven by the AI "hallucination" phenomena.

- In response, the National Court Administration (NCA) has established the "Task Force on Responding to AI-Driven Fabricated Claims and Evidence" (hereinafter referred to as the "TF").

TF Outcomes

- Feedback was gathered from courts at all levels, and research was conducted on relevant laws, regulations, foreign judicial precedents, practical trends, and international developments. 

- The proposed countermeasures aim to assist the judiciary in implementing necessary changes at this critical juncture. 

- Recommendations for amending relevant procedural laws and regulations have been submitted. 

- A plan to reorganize the information technology systems has also been suggested

- The increasing use of generative AI is an irreversible trend, and the courts must systematically prepare for the associated changes and risks. 

- The significance of the activities undertaken by this Task Force lies in developing countermeasures that will be reviewed at this stage and in laying the groundwork for an active response to future advancements in AI technology and shifts in operational environments. 

- The judiciary will continue to closely monitor the development of AI technology, its impact on trials, and changes in public perception to ensure timely follow-up measures. This approach will help maintain its essential judicial functions in a rapidly evolving environment.
