On March 20, 2014, the Supreme Court delivered en banc decision (Presiding Justice: Chief Justice YANG Sung-tae, Justice in charge: Justice KIM Chang-suk) that, “Despite the right of retention was acquired for an immovable that is under attachment of disposition for arrear, such circumstance does not disable the person having the right of retention who acquired the civil right of retention on the immovable before commencement of auction procedure thereof to exercise the right of retention to the buyer of auction procedure.”
