The Supreme Court(Chief Justice Yang Sung-tae as Presiding Justice and Justice Kwon Soon-il as Justice in Charge) on April 16, 2015 rendered an en banc decision that Article 58, Section 3, sub-section 1 of Enforcement Decree of Compensation Insurance for Work-related Injury Act does not apply to the person whose right to lump-sum compensation for disability has expired(2012Du26142). The law speculates that if the condition of a disability suffered by a person who has received lump-sum disability compensation benefits aggravated after given additional medical care and s/he files a claim for the payment of compensation annuities for disability, s/he shall not be paid the amount of compensation annuities for disability corresponding to the number of days for which the lump-sum disability compensation benefits have already been paid.
