The Supreme Court(Chief Justice Yang Sung-tae as Presiding Justice and Justice Kwon Soon-il as Justice in Charge) rendered an en banc decision on May 21, 2015 that an affirmed conviction, sentence for which is invalidated by a special amnesty can be a subject matter of a request for retrial as an affirmed conviction under Article 420 of the Criminal Procedure and the retrial court may not dismiss the case for the reason of amnesty and should decide on the merits.
