On September 15, 2015, the Supreme Court delivered en banc decision (Presiding Justice: YANG Sung-tae, Justice in charge: Justice KIM Yong-deok) that, "In principle, the spouse who has the principal responsibility for breakdown of matrimony shall not make divorce claim by the reason of the breakdown; and divorce claim of the spouse-at-fault is approved in exceptional cases when there are special circumstances in which the degree of responsibility on the breakdown of marriage does not remain to such an extent as to reject the divorce claim."
