¡¼Main Issue and Holding¡½ In a case where a person plays for money by committing an act that a person who wins at the betting on sports betting tickets or similar things issued by means of information and communications networks in the manner of connecting to, and betting on, foreign gambling websites in the area of the Republic of Korea obtains financial benefits, such act corresponds to an act of playing for money by committing an act prohibited under Article 26(1) of the National Sports Promotion Act, and thus whether such act may be punished by Article 48 Subparag. 3 of the same Act (affirmative) and whether this is likewise applicable in a case where the operation of sports gambling websites is made by foreigners outside the area of the Republic of Korea (affirmative)
