| ¡¼Main Issues and Holdings¡½ In the case where: Defendant A was prosecuted for violating the Narcotics Control Act (psychotropics) on the grounds that Defendant A handed over methamphetamine (meth) to Defendant B at his residence free of charge, and Defendant B received Meth from Defendant A free of charge as above, the Defendants were acquitted of the charges on the grounds that, although it is acknowledged that Defendant A handed over meth to Defendant B, it appears that Defendant A had Defendant B, who worked under his control, take the meth in order to deliver to a third party according to his instructions so as to deliver the meth to C, who jointly imported the meth along with Defendant A, and the evidence submitted by the prosecutor alone was insufficient to acknowledge that the Defendant B had the right to dispose of the meth or was in a relationship of control that allowed for the use or disposal of the meth as his own. | |
