| ¡¼Main Issues and Holdings¡½ In the case where: (a) Party A, who was appointed as a fire officer and retired after working for about 31 years, was diagnosed with ¡°Parkinson¡¯s Syndrome, Multiple System Atrophy¡± at a hospital and applied to the head of the Ministry for Patriots¡¯ and Veterans¡¯ Affairs with jurisdiction for registration as a person of distinguished service to the state; (b) the head of the Ministry for Patriots¡¯ and Veterans¡¯ Affairs with jurisdiction determined that the above injury or disease was not directly caused by the performance of duties, education and training directly related to the national defense, security, etc.; (c) however, the occurrence or worsening of the injury or disease had a significant causal relationship with the performance of duties; (d) Party A was subject to the requirements for persons eligible for veteran¡¯s compensation (military personnel or police officers injured in a disaster) but does not fall under the requirements for a person of distinguished service to the state (military personnel or police officers injured in the course of performing duties), it was held that Party A is subject to the requirements under Article 4(1)(vi) of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State. | |
