In the case where: Party A was born in the United States in 2001 to Korean national father and a United States national mother and held both nationalities at the same time, then declared the renouncement of nationality to the Minister of Justice via the Consulate General of the Republic of Korea in Seattle in 2018, but the Minister of Justice rejected this declaration on the grounds that Party A appeared to have kept a base and center for living in the Republic of Korea at the time of the report, it is held that the rejection disposition is unlawful on the grounds that it is sufficient to deem Party A as falling under “domiciled abroad” under Article 14(1) of the Nationality Act because Party A had a long-term and continuous base and center for living in the United States through an address in the United States.
