¡¼Main Issues and Holdings¡½ In a case where the defendant was charged with violating the Protection of Communications Secrets Act by recording with his mobile phone a conversation between his team leader, A, and a visitor, B, in the city hall office where he worked, it was held that the conversation between A and B constituted a ¡®conversation between others that is not made public¡¯ as defined in Article 3(1) of the Protection of Communications Secrets Act, and that the defendant's act of recording did not constitute a justifiable act under the criminal law.
