In a case where Defendant, the pastor in charge of Church A, was indicted for violating the Labor Standards Act and the Act on the Guarantee of Employees¡¯ Retirement Benefits by failing to pay a portion of the wages and retirement benefit owed to B within 14 days of the resignation date, after B had worked for approximately five (5) years and eight (8) months following his appointment as an evangelist at Church A by Defendant prior to resigning, considering all circumstances, the court found Defendant guilty of the charges regarding unpaid wages and retirement benefit, on the grounds that B qualifies as an employee under the Labor Standards Act.
