Summary
[1] The purport of newly enacted Item 2 of Article 50 (6) and Item 4 of Article 65 (1) of the former Act on Promotion of Information and Communications Network Utilization and Information Protection, etc, which prohibit the acts of ""combining the numbers, etc."" or ""automatically creating telephone numbers, etc,"" and the method of determining whether an act falls under the above provisions [2] The case holding that the acts, for making profits which consist of commissions obtained from attracting cell phone subscribers, automatically creating lots of cell phone numbers by using the auto input function of excel program installed on the computer and then transmitting text messages for cell-phone advertising to those cell phone numbers many times, constitute the crime of violation of Item 2 of Article 50 (6) of the former Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
