| In a case where Party A and others, who were bar examination examinees, filed a claim for damages against the State alleging that the State committed unlawful acts during the process of preparing and administering the examination, thereby infringing upon the right of Party A and others to be fairly evaluated by the bar examination, the court dismissed Party A and others’ claim for damages on the grounds that the State’s actions cannot be deemed as unlawful in light of the various circumstances despite the acknowledgment that: controversy arose over one of the record-based questions of the bar examination being similar to the lecture materials from a specific law school, whereupon the Bar Examination Management Committee passed a resolution to “award full marks to all examinees” for that question; the Minister of Justice issued an announcement only three days before the examination prohibiting notes in legal texts and provided guidance during the examination period through text messages specifying that underlining in legal texts was permitted; and an examination supervisor misinterpreted the examination end signal, so the chief examination officer granted additional time to the remaining examinees who raised objections approximately 20 minutes after the examination ended | |
